Pan Symeou, together with Jonathan Higgs KC, successfully secured the acquittal of the defendant who was charged with possessing a prohibited weapon, namely a firearm.
The Prosecution’s case was that the defendant was in possession of a sawn-off shotgun, which was found near his home and tested positive for his DNA. The Crown also provided evidence that JS had an existing interest in firearms and shotguns. The defence successfully argued, however, that it was highly plausible that the defendant’s DNA was on the firearm via secondary transfer or some other way. Likewise, the defendant’s DNA could have been transferred onto the firearm before it was sawn-off and therefore before it became a prohibited firearm.
